Banking Fears Have Put Billions of Dollars in Weed Profits in Limbo... Until Now

Think about the last time you ran out for a bottle of wine or stopped someplace after work for a few groceries: Did you have to swing by an ATM first? Did you make sure you had plenty of cash in your wallet to cover the cost?

If you're like most Americans in 2018, the answer is probably... of course not.

It's more likely you used a debit or credit card, or even iOS, Android, Venmo, or PayPal. A debit here, a credit there, all effortlessly unfolding in the ones and zeros of cyberspace.

I'm simplifying here, but the cashless, convenient transaction between you and the merchant took place via computer - your bank, the merchant's bank, the clearinghouse - everyone involved used the U.S. communications network and financial system to "settle up" and get business done.

Now, I'm going to ask you to imagine something completely ridiculous - just for a second.

Meng Arrest: "Economic Hardball of the Highest Order"
Huawei Technologies is a Chinese multinational telecommunications-equipment and consumer-electronics company based in Shenzhen, Guangdong, South China.

The arrest of Chinese citizen and Huawei CFO Meng Wanzhou under U.S. Law in a third country for violations of sanctions related to Iran is a very serious development that comes at a very unfortunate time.

Interestingly enough, the charges stem from an alleged breach of the 2015 Obama-Xi agreement on cyber/IP theft. Huawei has actually been blocked from selling network systems in the United States since 2012.

What next? Beijing will bluster, as will Huawei.

The former will on concerns about how this will impact trade talks, while the latter will play to America's $1.3 trillion 5G mobile network aspirations and argue along the lines of "Let's see you even try it without Huawei."

China will act in China's interest no matter what agreements are in place. It doesn't view contracts the same way we do. What's more, the Chinese public-private sector's understanding of intellectual property law is maturing - but still lags a generation or more behind, as do enforcement efforts.

As we've seen, the markets will sell off on not-unfounded fears of chip supply. In fact, that's a different equation, and one related to the high levels of computerization that are engaged in a race "down the stairs" as each new threshold is reached - that's a story for a different day.

Right now, what Meng's arrest tells me is that the Trump administration is a) deadly serious and b) has given the green light to criminal enforcement action. There will probably be more to follow.

The arrest, incidentally, is key.

I've been talking for a long time about the need to "embarrass" China on the global stage it so desperately wants to stand on. Why? Because it would cause a loss of face that China will definitely respond to, versus tariff it to oblivion, which it won't care about.

Make no mistake about it: This is a definitive step in that direction.
